Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Audubon Audio website, products, and Members Area, operated by Audubon Studios LLC, doing business as Audubon Audio ("Audubon Audio", "we", "us"). By creating an account or making a purchase, you agree to these Terms. If you don't agree, please don't use the service.
1. Accounts
You must provide accurate information when creating an account and keep your login credentials secure. You're responsible for activity that happens under your account. You must be old enough to form a binding contract in your jurisdiction to make a purchase. Account access during beta may require an invite.
2. Purchases & payment
Purchases are processed by our payment provider, Lemon Squeezy, which acts as the Merchant of Record. This means Lemon Squeezy handles the transaction, billing, and any applicable sales tax or VAT, and their terms also apply to the payment. Prices are shown at checkout and may change over time. We reserve the right to refuse or cancel an order where we suspect fraud or error.
3. License to use our products
When you buy a digital product (plugin, sample pack, presets, etc.), we grant you a non-exclusive, non-transferable license to use it for your own music production, including commercial productions, subject to these Terms. License serial numbers are issued to you personally. You may not:
- Share, resell, sublicense, or redistribute the product or your serial number
- Redistribute sample/preset content as a competing sample library or preset pack
- Reverse-engineer, decompile, or circumvent licensing or copy protection
We retain all intellectual property rights in our products. We may revoke a license that is shared, obtained fraudulently, or used in violation of these Terms. Our software plugins are also governed by our End User License Agreement (EULA), which covers installation, warranty, and liability for the software itself.
4. Refunds
Our products are digital and delivered immediately, and every plugin comes with a free 14-day trial so you can install it, run it in your own DAW, and make sure it's right for you before you buy. Because you've had the chance to fully test the exact product you're purchasing, all sales are final and we do not offer refunds as a matter of course once a license has been issued.
That said, we're a small team and we try to be fair. If you hit a technical problem, a billing error (such as a double charge), or you're in a genuinely difficult situation, email audubonaudioshop@gmail.com and we'll do our best to work it out with you. Please reach out to us before filing a chargeback with your bank — a quick email is almost always faster, and we can usually resolve it directly.
Where the law grants you refund or cancellation rights that can't be waived, those still apply, and refunds are also subject to Lemon Squeezy's policies as our Merchant of Record. See our full Refund Policy for details.
5. Lessons
Lesson bookings are requests until confirmed by us. Once a session is confirmed, we ask that you give at least 24 hours' notice to reschedule or cancel. Sessions cancelled with less than 24 hours' notice, or missed without notice ("no-shows"), may be forfeited (and any fee for them may be non-refundable). If we ever need to reschedule on our side, we'll offer you a new time or a refund of any amount paid for that session. Lessons are educational — we share guidance and feedback, but we can't guarantee any specific result, placement, or outcome.
6. Acceptable use
You agree not to:
- Use the service for any unlawful purpose or to infringe others' rights
- Attempt to gain unauthorized access to accounts, systems, or data
- Interfere with or disrupt the service, or attempt to bypass security or rate limits
- Use automated means to scrape or abuse the service
7. Beta feedback
If you submit feedback, bug reports, or suggestions, you grant us permission to use them to improve our products without obligation or compensation to you.
8. Disclaimers
The service and products are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. During beta in particular, we do not warrant that the service will be uninterrupted, error-free, or compatible with every system or DAW.
9. Limitation of liability
To the fullest extent permitted by law, Audubon Audio will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the service or products. Our total liability for any claim relating to the service is limited to the amount you paid us for the product giving rise to the claim.
10. Termination
We may suspend or terminate your account if you violate these Terms. You may stop using the service and request account deletion at any time by emailing us. Provisions that by their nature should survive termination (e.g. license restrictions, disclaimers, limitation of liability) will survive.
11. Changes to these Terms
We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date, and notify registered users by email of material changes. Continued use after changes means you accept them.
12. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Colorado.
